KNOWVAN Terms of Service

Version 1.0 — draft for pre-launch review

These Terms govern bookings for instruction and related services offered through KNOWVAN. By submitting a booking and accepting these Terms, the customer agrees to the following conditions, subject always to rights and remedies that cannot lawfully be excluded or limited.

1. Booking and payment

A requested time is not confirmed until required payment has been received and KNOWVAN has issued confirmation. The customer must provide accurate booking and contact information. KNOWVAN may decline or cancel a booking where necessary, in which case amounts paid for services not provided will be refunded or, at the customer's option, applied to an agreed replacement booking.

2. Customer cancellations and rescheduling

A customer giving more than 48 hours' notice may request one reschedule, subject to availability. With 48 hours' notice or less, no reschedule or refund is offered. Failure to attend is treated as a completed booking for payment purposes. These terms do not limit any rights that cannot legally be limited.

3. Late arrival

A late arrival does not extend the scheduled end time. KNOWVAN may treat substantial lateness as a no-show where the remaining time is insufficient to provide the service reasonably.

4. Weather and outdoor sessions

Ordinary weather does not automatically cancel an outdoor session. KNOWVAN may reschedule an outdoor session where conditions are unsafe or materially unsuitable. If KNOWVAN cannot provide the booked service, the customer will be offered a replacement date or refund as applicable.

5. Equipment, devices and accounts

Customers remain responsible for their cameras, phones, computers, accessories, accounts, passwords, files, backups, subscriptions and other property. Customers should maintain appropriate backups and security. KNOWVAN is not responsible for ordinary equipment failure, incompatibility, third-party service interruption, data loss or customer error except to the extent liability cannot lawfully be excluded.

6. Instruction and results

Services are educational. No particular creative, technical, commercial or professional result is guaranteed. Photography instruction may involve walking, outdoor conditions, traffic, terrain and use of customer-owned equipment. Customers are responsible for exercising ordinary care and following applicable laws and safety requirements.

7. Artificial intelligence instruction

AI systems may produce inaccurate, incomplete, biased or unsuitable output and may change without notice. KNOWVAN does not warrant the availability, accuracy or suitability of third-party AI products. The customer remains responsible for reviewing outputs and for decisions, publications, submissions or other uses made from them. AI instruction is not legal, medical, financial or other regulated professional advice.

8. Conduct

KNOWVAN may end a session for harassment, threatening or abusive behaviour, intoxication, unsafe conduct, unlawful activity or conduct that materially prevents the service from being delivered. Where termination results from the customer's conduct, no refund is offered.

9. Minors

Services are intended for adults unless KNOWVAN expressly agrees otherwise. A parent or legal guardian must arrange any approved booking involving a minor and may be required to attend.

10. Limitation of liability

To the maximum extent permitted by law, KNOWVAN is not liable for indirect, incidental, special, exemplary or consequential loss arising from the services or use of third-party products. Where liability may lawfully be limited, KNOWVAN's aggregate liability relating to a booking will not exceed the amount paid for that booking. Nothing in these Terms excludes liability or consumer rights that applicable law prohibits KNOWVAN from excluding or limiting.

11. Third-party services

Google, Apple, OpenAI, camera manufacturers, software vendors, payment networks and other third parties operate independently of KNOWVAN. Their products, availability, policies, charges and performance are outside KNOWVAN's control.

12. Privacy

Booking information is collected and used for scheduling, payment administration, customer communication, recordkeeping and service delivery. Marketing communications require separate consent where required. Customers should not submit passwords or unnecessary sensitive information.

13. Reviews and legal rights

Nothing in these Terms prevents a customer from communicating an honest review or exercising rights under applicable consumer-protection law. Any provision that is prohibited or unenforceable is ineffective only to the extent required, and the remaining provisions continue to apply.

14. Governing law

These Terms are governed by the laws of British Columbia and the applicable laws of Canada, subject to mandatory consumer rights and jurisdictional rules.

15. Changes and records

The version accepted at the time of booking governs that booking unless the parties later agree otherwise or applicable law requires otherwise. KNOWVAN may update terms for future bookings.
